WHAT IS THE DIFFERENCE BETWEEN A STANDARD TRANSLATION AND A SWORN TRANSLATION?
Essentially, a sworn translation is a standard translation that has been certified by a sworn translator. A sworn translator is a linguist who has been appointed by the Ministry of Foreign Affairs, European Union and Cooperation. When a standard translation is certified, the sworn translator takes responsibility and attests to the content he/she has translated. Sworn translations can be done of any documents.
Sworn translations:
✅ Have been certified by a sworn translator (authorised by the Ministry of Foreign Affairs).
✅ May be delivered as a hard copy (signed and sealed by the translator) or as a digitally signed pdf file. No changes can be made to the document after it has been certified.
✅ Have official standing.
Standard translations:
✅ Are not certified (commonly known as “regular translations”).
✅ May be delivered in an editable format (such as a .doc file) and the customer can modify its content.
✅ Have no official standing.

As a disciple, translation has numerous ramifications. There are as many and specialties as there are types of texts. Any written document can be translated, just like any speech or phrase can be interpreted.
When it comes to conveying a message in another language, it is key to rely on qualified professionals. Knowing two languages does not make you a translator in the same way that having two hands does not make you a pianist. In addition to a solid command of the grammar and spelling of the source and target language, any translation professional needs extensive knowledge of the specific subject matter at hand.
In Tradujuarez, we have been working in legal and judicial environments for many years now. Our specialisation in the legal sphere is a natural consequence of working as sworn translators: most of our assignments involve litigation, legal/administrative proceedings, negotiations and court cases. Sworn translations
Sworn translations are those that bear the stamp and the signature of a sworn translator, a person authorised by the Spanish Ministry of Foreign Affairs, European Union and Cooperation to certify translations. In doing so, the translator agrees to ensure that the content of the translated file is true to the original, that is, that the original source document is equivalent to the translated text. Sworn translations can be done of any documents whatsoever.
Sworn translations are generally required for international procedures: residence permits, adoption, foreign university applications, etc. It is up to each institution or public body (universities, government authorities, registries, police) to decide whether a sworn translation is needed. For example: if a Spanish graduate is applying for a Master’s degree program at Harvard University, he/she will be required to prove his/her qualifications by providing a sworn translation of his/her diploma(s).
Sworn translations must bear the stamp and signature of the sworn translator on every page, as well as the so-called “sworn declaration” on the last page of the document. The declaration attests to the authorship of the translation and the authority by which it was sworn. It is the standard working established by the Ministry of Foreign Affairs.
It is worth noting that sworn translations attests only to the fidelity and accuracy of the translation, and not to the authenticity of the source documents or its signatures. That kind to authentication would fall within the powers of a Notary Public.
Standard translations
The term “standard” refers to any translation that does no require the stamp and signature of an authorised translator, as opposed to “sworn” translations. This applies to any text that needs to be translated from a language into a different one, from a detective novel to a political speech in the European Parliament.
Legal translations
Legal translations are those whose content or purpose fall within the legal domain. They are not necessarily official documents, but usually contain terms and phrasing unique to lawyers, or are related to some branch of law.
Legal translations should not be mistaken for sworn translations: “legal” refers to the content (law-related), while “sworn” refers to the format (stamped or sworn).
In a nutshell,
A legal translation is the result of translating a legal text.
A sworn translation in the result of swearing/certifying a translation.
Court interpreting
In court, it is not uncommon for some of the persons involved (plaintiff, defendant, experts or witnesses) to be natives of another country whose first language is not the language of the courtroom. In these cases, the assistance of an interpreter is required.
To act as a court interpreter, it is essential to be familiar with court conventions and legal terminology and phrasing. Moreover, the interpreter must know when to intervene, when to yield the floor and when to ask for a pause, as well as the courtroom protocols. This will guarantee effective legal protection, that is, the right of every person to exercise the defence of his or her legitimate interests before the courts.
Sworn interpretation must be true to the original testimony, aim for brevity but without omitting any important detail, and always remain impartial. It uses discursive strategies to convey, for example, the hesitation of a stutter or the frustration of a grunt, without having to replicate the onomatopoeias. In short, the interpreter must be the voice and ears of the foreign person in court.
SWORN TRANSLATION FOR BUSINESSES AND INDIVIDUALS
Requests for sworn translations are constantly coming in. Some of them come from individuals dealing with different kinds of proceedings (residence permits applications, international adoption, enrollment in foreign universities) while other come from the companies that manage those proceedings (consultancies and agencies) or with their own proceedings underway. Here are some examples:
Sworn translations for companies
✅ Necessary in almost every step of any international mergers and acquisitions process.
✅ Multinationals based in different countries or working through subsidiaries must resort to sworn translations to standardise processes.
✅ We work with law firms in translating court documents, and with legal consultancies in the preparation of applications for residence permits, purchase and sale of real estate, intestacy, donations, separation of assets, and many others.
✅ We are used to the hectic pace of law firms and cope well with their deadlines.
Sworn translations for individuals
✅ When applying for the international recognition or validation of a degree, you will be asked for sworn translations of your diplomas and transcripts.
✅ When applying for a residence permit, you will be asked to submit the sworn translation of your birth certificate.
✅ In international adoption procedures, sworn translations of all the documents requested (income tax return, criminal records, basic health data, employment records, etc.) must be submitted.
✅ If you have lived abroad and now wish to apply for a mortgage in Spain, you will be asked to provide a sworn translation of your payslips, and the public deeds of any property you own abroad.
✅ If you wish to sell a property to a foreign person or claim an inheritance that was awarded outside Spain, you will need the sworn translations of all the public deeds involved.

What kind of sworn translations are usually requested by companies?
A company’s articles of association is a document which form the company’s constitution, and defines the responsibilities of the directors, the kind of business to be undertaken, and the means by which the shareholders exert control over the board of directors.
A power of attorney is a written authorization, granted before a Notary Public, to represent or act on another’s behalf in private affairs, business, or some other legal matter.
The noun “contract” is believed to come from the Latin word contractus, meaning “joint, united, agreed”. That is, in essence, the purpose of any contractual document: to bind two parties by the signing of a document.
In each country, contracts have specific structures and phrases that must be observed in the translation, making sure not to incur in false friends or foreign structures.
A notarial act is a public document executed before a notary public and offering the maximum legal certainty in our system. Their effects are specifically regulated by law, and go far beyond the effects of any private document.
A public tender is a publicly advertised solicitation of bids opened in public by a government entity. On an equal opportunity basis, interested bidders may submit their bids and the contract will be awarded to the most suitable proposal.
What kind of sworn translations are usually requested by individuals?
This includes any diploma or academic certificate, as well as any qualification overview.
Depending on the country, these may requiere the sworn translation of criminal records, certificate of sexual offences, marriage certificate, passports, letters of recommendation, certificates of donations, tax records, medical records and exams, guardianship acceptance letters, deeds of property, hearing procedures, etc.
These sworn translations are generally required in procedures involving residence, citizenship or naturalisation, inheritance, or any administrative proceeding related to family law.
A residence permit is a government authorisation for non-EU foreigner to legally stay in Spain for more than 90 days. The residence permit is usually issued for a period of 2 years, renewable up to 5 years. After 5 years of holding the temporary residence permit, a foreign national will be eligible for permanent residency.
A divorce decree or judgement is a formal order issued by the court at the end of the divorce proceeding. They are usually required as part of custody proceedings and administrative formalities related to the Civil Registry.
There are may different types of medical certificates. A Spanish patient who was treated in a foreign hospital will be required to produce the translation of his/her foreign medical record if he/she wish to continue the treatment in Spain, and vice versa. These certficates are also required when applying for certain subsidies or in international adoption applications.
It is a certificate proving either the lack or existence of criminal records in the Central Criminal Registry on the date of issue. A sworn translation of criminal records is generally required when applying for certain jobs and in international adoption applications.
OUR WORK METHODOLOGY FOR SWORN TRANSLATIONS
1. Reading and analysing the source document.
Identifying any terms or concepts that could entail translation problems.
2. Search for equivalent documents in the target language.
Finding out whether there is a similar or equivalent type of document in the county of destination, and which terms or phrases are generally used in that context.
3. Preliminary translation.
First draft of the translation (unformatted).
4. Layout and formatting.
We edit the format of the translated file in order to make it as consistent as possible with the source document. In doing that, we transcribe the content of any stamps, seals and handwritten notes.
5. Review and unification of content.
A thorough review of the latest formatted version is performed, correcting any inaccuracies and unifying the style.
6. Certification
We stamp, sign and time-stamp all pages. The last page of every sworn translation must include a sworn certification, along with our stamp and signature. Lastly, we attach a copy of the source file, as required by current regulations, all pages of which must be stamped and dated by the translator.

Frequently asked questions about sworn translation
How long does a sworn translation take?
This depends largely on the length of the original document. For a university degree, for example, our usual deadline is two working days. A 6,000-word document would take us about a week.

How do I know if someone is a sworn translation?
You may easily check the official list of sworn translators and interpreters that is published and regularly updated by the Spanish Ministry of Foreign Affairs, European Union and Cooperation: ( https://www.exteriores.gob.es/es/ServiciosAlCiudadano/Paginas/Traductores-Interpretes-Jurados.aspx ).
Which documents are required for a sworn translation?
All we need is a scanned copy of the original document. Also, please let us know whether you need the translation in digital format (electronic signature) or in hard copy form.
Are digitally sworn translations as valid as those in hard copy form?
Until recently, Spanish sworn translations were only accepted as valid by the Spanish authorities when submitted in hard copy form. However, as a result of the Covid-19 lockdown, the Ministry of Foreign Affairs approved the validity of the digital format for online filing, provided that all the requirements in terms of digital signature and stamp were met.
Article 10 of Spanish Law 39/2015, of 1 October, on Common Administrative Procedure of Public Administrations, contains a list of the signature systems admitted by the Spanish Administration, Since Public Administrations are the main recipients of sworn translations, it is admissible that they be signed electronically by means of one of the systems set forth in the aforementioned article.

Nowadays, nearly all Public Administrations admit translations in digital format, but it is worth checking with them beforehand.
What is an apostilled translation?
An apostille authenticates the seals and signatures of officials on public documents. A foreign institution may require that a sworn translation be apostilled, too. This is an additional procedure and, depending on the type of document, it must be carried out by a Spanish Notary Public or a territorial office of the Ministry of Justice.
Do I need to notarise or legitimise a sworn translation?
No, unless so required by the entity that originally requested the sworn translation. In those cases, the sworn translation would have to visit a Notary office and have their signature legitimised. The notarial fee would be added to the price of the translation.
